Not at FSL Gujarat, lie test of IPS officer Dheeraj Sethia at CBI lab in Delhi

GURUGRAM: The polygraph test of IPS officer Dheeraj Sethia, who was suspended by the state government after he was accused of taking a bribe from a suspect in a sensational multi-crore cash heist from two highrise apartments in the city, will be conducted at Central Forensic Science Laboratory of the CBI in Delhi, a local court ordered on Friday.
Sethia, who was to take the test at the Forensic Science Laboratory (FSL) in Gandhinagar, had moved an application in court, objecting to its conduct and procedures. Sethia visited FSL Gandhinagar in July and August for the polygraph test, but alleged his lawyers were not allowed at the time of the test. Eventually, the test wasn’t done.
On May 31, a Gurgaon court ordered the polygraph test. After his first visit to Gandhinagar in July, Sethia moved another application in court, asking for the presence of his lawyers during the test. On July 25, the court allowed the application. Sethia told the court he went to Gandhinagar again with the order in which the names of the two lawyers accompanying him were mentioned but was told that the lawyers would not be allowed during preliminary interrogation and could sit in an adjoining room while the lie-detector test was recorded.
The test wasn’t conducted again and Sethia moved another plea before court. Referring to the STF of Haryana Police, which is investigating the heist and booked him, Sethia said in his application, “STF on its own had got the test of Dr Gurpratap Singh, one of the accused in the case, conducted from FSL of CBI in New Delhi but in my case, they are trying to influence the result against the applicant by choosing FSL as per their convenience.”
Additional sessions judge Tarun Singal on Friday observed that the apprehension raised by the applicant that the test may not be fair or impartial is not totally misplaced. “Significantly, the lie-detector test of accused Dr Gurpratap Singh has already been conducted from FSL CBI New Delhi. The said fact was fairly conceded by the prosecution. Hence, the court sees no reason as to why the lie-detector test of accused Dheeraj Sethia is not conducted from the same lab.”
Sethia was DCP (south) with additional charge as DCP (crime) when the massive cash heist happened from two flats on August 4 last year. Sethia was named as an accused by the STF, which added sections of the Prevention of Corruption Act and section 411 (dishonestly receiving stolen property) of the IPC to the FIR registered at Kherki Daula police station. Sethia was suspended on August 10.
The policeman’s name came up in a statement of Dr Suchinder Kumar Nawal, one of the accused. Among the accused are three doctors and henchmen of gangster Vikas Langarpuria, who allegedly orchestrated the heist after one of the doctors learnt of the cash from a staffer at the developer’s office.
